Welcome to FocusPlate. These Terms of Service ("Terms") govern your use of the FocusPlate mobile application ("App") and website at focusplate.online ("Website"), operated by FocusPlate Studios ("we," "us," or "our").

By downloading, installing, or using FocusPlate, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. Service Description

FocusPlate is an AI-powered meal planning application that generates personalized daily meal suggestions based on your dietary goals, preferences, and restrictions. The service includes daily meal plans, recipes, grocery lists, and fast-food alternative suggestions.

2. Account Registration

• You must be at least 13 years old (or 16 in the EEA) to create an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate and complete information during registration.
• You are responsible for all activity that occurs under your account.
• Notify us immediately if you suspect unauthorized access to your account.

3. Subscription & Billing

Free Tier

FocusPlate offers a free tier with limited features, including a 7-day full access trial for new users and 1 free meal suggestion per day thereafter.

Pro Subscription

• Pro Monthly: $7.99 per month, billed monthly.
• Pro Annual: $59.99 per year, billed annually.

Billing & Renewals

• Subscriptions are billed through your Apple App Store or Google Play Store account.
• Subscriptions auto-renew unless canceled at least 24 hours before the end of the current billing period.
• You can manage and cancel your subscription in your device's App Store or Play Store settings.

Refunds

Refund requests are handled by Apple or Google according to their respective refund policies. We do not directly process refunds. If you believe you are entitled to a refund, contact Apple App Store Support or Google Play Support.

4. Acceptable Use

You agree not to:

• Use the App for any illegal or unauthorized purpose.
• Reverse engineer, decompile, or disassemble the App.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Use the App to distribute malware, spam, or harmful content.
• Resell, redistribute, or sublicense the App or its content.
• Use automated systems (bots, scrapers) to access the App.

5. Health & Medical Disclaimer

⚠️ IMPORTANT: FocusPlate is a meal planning convenience tool and is NOT a medical service, dietary consultation, or nutrition therapy. Our content:

• Is generated by artificial intelligence and is not reviewed by healthcare professionals.
• Should not be used as a substitute for professional medical advice, diagnosis, or treatment.
• May not be appropriate for individuals with specific medical conditions, eating disorders, severe allergies, or complex dietary needs.

Always consult with a qualified healthcare provider before making significant changes to your diet, especially if you are pregnant, nursing, have a medical condition, or are taking medication.

FocusPlate Studios is not responsible for any health consequences resulting from following AI-generated meal suggestions.

6. Intellectual Property

• The FocusPlate App, Website, logo, design, and content are the intellectual property of FocusPlate Studios.
• You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
• AI-generated meal plans and recipes provided to you are for your personal use only.
• You may not reproduce, distribute, or commercially exploit our content without written permission.

7. User Content

If you submit feedback, suggestions, or other content to us, you grant FocusPlate Studios a non-exclusive, royalty-free, worldwide license to use, modify, and incorporate such content into our services.

8. Service Availability

• We strive to maintain high availability but do not guarantee uninterrupted access to the App.
• We may perform maintenance, updates, or modifications that temporarily affect availability.
• We reserve the right to modify, suspend, or discontinue features at any time with reasonable notice.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• FocusPlate Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability for any claim arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.
• We are not liable for the accuracy, completeness, or nutritional adequacy of AI-generated meal plans.

10. Indemnification

You agree to indemnify and hold harmless FocusPlate Studios and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the App, violation of these Terms, or infringement of third-party rights.

11. Termination

• We may terminate or suspend your account at any time for violation of these Terms.
• You may delete your account at any time through the App's settings.
• Upon termination, your right to use the App ceases immediately. Data deletion follows our Privacy Policy.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which FocusPlate Studios is incorporated, without regard to conflict of law principles.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be settled through binding arbitration, except where prohibited by law.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least 30 days before taking effect. Continued use of the App after changes constitutes acceptance.
